SCHEDULE 5Foreign travel restriction orders
Breach of foreign travel restriction order an offence

1
A person commits a offence who, without reasonable excuse—
a
does anything they are prohibited from doing by a foreign travel restriction order, or
b
fails to comply with a requirement imposed on them by such an order.

A person guilty of an offence under this paragraph is liable—
a
on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding the statutory maximum or both;
b
on conviction on indictment, to imprisonment for a term not exceeding 5 years or a fine or both.

In the application of this paragraph in England and Wales, the reference in sub-paragraph (2)(a) to 12 months is to be read as a reference to the general limit in a magistrates’ court (or to 6 months in relation to an offence committed before 2 May 2022).

Where a person is convicted of an offence under this paragraph, it is not open to the court by or before which they are convicted—
a
in England and Wales or Northern Ireland, to make an order for conditional discharge in respect of the offence;
b
in Scotland, to make a probation order in respect of the offence.
