http://www.legislation.gov.uk/ukpga/2008/28/section/24/2016-09-22Counter-Terrorism Act 2008An Act to confer further powers to gather and share information for counter-terrorism and other purposes; to make further provision about the detention and questioning of terrorist suspects and the prosecution and punishment of terrorist offences; to impose notification requirements on persons convicted of such offences; to confer further powers to act against terrorist financing, money laundering and certain other activities; to provide for review of certain Treasury decisions and about evidence in, and other matters connected with, review proceedings; to amend the law relating to inquiries; to amend the definition of “terrorism”; to amend the enactments relating to terrorist offences, control orders and the forfeiture of terrorist cash; to provide for recovering the costs of policing at certain gas facilities; to amend provisions about the appointment of special advocates in Northern Ireland; and for connected purposes. 9texttext/xmlenStatute Law Database2024-05-18Expert Participation2016-09-22 Part 2Post-charge questioning of terrorist suspectsPost-charge questioning: Northern Ireland241The following provisions apply in Northern Ireland.2A district judge (magistrates' courts) may authorise the questioning of a person about an offence—aafter the person has been charged with the offence or been officially informed that they may be prosecuted for it, orbafter the person has been committed for trial for the offence,if the offence is a terrorism offence.3The judge—amust specify the period during which questioning is authorised, andbmay impose such conditions as appear to the judge to be necessary in the interests of justice, which may include conditions as to the place where the questioning is to be carried out.4The period during which questioning is authorised—abegins when questioning pursuant to the authorisation begins and runs continuously from that time (whether or not questioning continues), andbmust not exceed 48 hours.This is without prejudice to any application for a further authorisation under this section.5Where the person is in prison or otherwise lawfully detained, the judge may authorise the person's removal to another place and detention there for the purpose of being questioned.6A district judge (magistrates' courts) must not authorise the questioning of a person under this section unless satisfied—athat further questioning of the person is necessary in the interests of justice,bthat the investigation for the purposes of which the further questioning is proposed is being conducted diligently and expeditiously, andcthat what is authorised will not interfere unduly with the preparation of the person's defence to the charge in question or any other criminal charge.7Codes of practice under Article 65 of the Police and Criminal Evidence (Northern Ireland) Order 1989 (S.I. 1989/1341 (N.I. 12)) must make provision about the questioning of a person by a constable in accordance with this section.8Nothing in this section prevents codes of practice under that Article making other provision for the questioning of a person by a constable about an offence—aafter the person has been charged with the offence or been officially informed that they may be prosecuted for it, orbafter the person has been committed for trial for the offence.9In Article 3(1) of the Criminal Evidence (Northern Ireland) Order 1988 (S.I. 1988/1987 (N.I. 20)) (effect of accused's failure to mention facts when questioned or charged: circumstances in which the article applies) after sub-paragraph (b) insert—; or cat any time after being charged with the offence, on being questioned under section 24 of the Counter-Terrorism Act 2008 (post-charge questioning), failed to mention any such fact,.10Nothing in Article 5 or 6 of that Order (effect of accused's failure or refusal to account for certain matters) is to be read as excluding the operation of those Articles in relation to a request made in the course of questioning under this section.

<Text>The following provisions apply in Northern Ireland.</Text>

<Text>A district judge (magistrates' courts) may authorise the questioning of a person about an offence—</Text>

<Pnumber>a</Pnumber>

<Text>after the person has been charged with the offence or been officially informed that they may be prosecuted for it, or</Text>
</P3para>
</P3>

<Text>after the person has been committed for trial for the offence,</Text>

<Text>if the offence is a terrorism offence.</Text>

<Pnumber>3</Pnumber>

<Text>The judge—</Text>

<Text>must specify the period during which questioning is authorised, and</Text>
</P3para>

<Text>may impose such conditions as appear to the judge to be necessary in the interests of justice, which may include conditions as to the place where the questioning is to be carried out.</Text>

</P3>

</P2>

<Pnumber>4</Pnumber>

<Text>The period during which questioning is authorised—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2008/28/section/24/4/a/2016-09-22" IdURI="http://www.legislation.gov.uk/id/ukpga/2008/28/section/24/4/a" id="section-24-4-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>begins when questioning pursuant to the authorisation begins and runs continuously from that time (whether or not questioning continues), and</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>

<Text>must not exceed 48 hours.</Text>
</P3para>
</P3>
</P2para>
<P2para>
<Text>This is without prejudice to any application for a further authorisation under this section.</Text>
</P2para>
</P2>

<Pnumber>5</Pnumber>

<Text>Where the person is in prison or otherwise lawfully detained, the judge may authorise the person's removal to another place and detention there for the purpose of being questioned.</Text>
</P2para>
</P2>

<Pnumber>6</Pnumber>

<Text>A district judge (magistrates' courts) must not authorise the questioning of a person under this section unless satisfied—</Text>

<Pnumber>a</Pnumber>

<Text>that further questioning of the person is necessary in the interests of justice,</Text>
</P3para>
</P3>

<Text>that the investigation for the purposes of which the further questioning is proposed is being conducted diligently and expeditiously, and</Text>

Codes of practice under Article 65 of the Police and Criminal Evidence (Northern Ireland) Order 1989 (
<Acronym Expansion="Statutory Instrument">S.I.</Acronym>
1989/1341 (N.I. 12)) must make provision about the questioning of a person by a constable in accordance with this section.

<Text>Nothing in this section prevents codes of practice under that Article making other provision for the questioning of a person by a constable about an offence—</Text>

<Text>In Article 3(1) of the Criminal Evidence (Northern Ireland) Order 1988 (S.I. 1988/1987 (N.I. 20)) (effect of accused's failure to mention facts when questioned or charged: circumstances in which the article applies) after sub-paragraph (b) insert—</Text>
