Enforcement of relevant requirements

83ZQInjunctions: prevent failure to comply with relevant requirement

If, on the application of the Bank of England, the court is satisfied that there is a reasonable likelihood that any person will contravene a relevant requirement, the court may make an order restraining (or in Scotland an interdict prohibiting) the contravention.

The jurisdiction conferred by this section is exercisable—

a

in England and Wales and Northern Ireland, by the High Court, and

b

in Scotland, by the Court of Session.

In this section “relevant requirement” has the meaning given in section 83ZD.
