Apprenticeships, Skills, Children and Learning Act 2009

An Act to make provision about apprenticeships, education, training and children's services; to amend the Employment Rights Act 1996; to establish the Young People's Learning Agency for England, the office of Chief Executive of Skills Funding, the Office of Qualifications and Examinations Regulation and the School Support Staff Negotiating Body and to make provision about those bodies and that office; to make provision about the Qualifications and Curriculum Authority; to make provision about schools and institutions within the further education sector; to make provision about student loans; and for connected purposes.

Part 10Schools

Chapter 4School Support Staff Pay and Conditions: England

General

I1240“School support staff”

This section has effect for the purposes of this Chapter.

“School support staff” are persons within subsection (3).

A person is within this subsection if the person—

a

is employed by a F1local authority in England or the governing body of a school maintained by a F1local authority in England, under a contract of employment providing for the person to work wholly at a school or schools maintained by a F1local authority in England;

b

is not a school teacher, or a person of a prescribed description.

In this section, “school teacher” means a person who is a school teacher for the purposes of section 122 of the Education Act 2002 (c. 32).
