This paragraph applies if—

a

a person has contravened paragraph 5(1), and

b

the responsible authority thinks the contravention may immediately and materially increase or alter a flood risk or coastal erosion risk.

The authority may—

a

act to remedy the contravention without giving an enforcement notice,

b

require the owner to pay the expenses of that action, and

c

recover the expenses as a debt.
