If a person is convicted of an offence under section 9 by reason of using a design on an article, or in connection with an article, the court by which the person is convicted may order the forfeiture of the article.

The court may also make such provision as appears to it to be necessary for giving effect to the forfeiture.

That provision may include, in particular, provision relating to the retention, disposal or destruction of the article.

Provision made under this section may be varied at any time by the court that made it.
