All fees, charges, penalties and other sums received by the Commissioner in carrying out the Commissioner's functions are to be paid by the Commissioner to the Secretary of State.

Sub-paragraph (1) does not apply where the Secretary of State, with the consent of the Treasury, otherwise directs.

Any sums received by the Secretary of State under sub-paragraph (1) are to be paid into the Consolidated Fund.
