The Criminal Justice and Immigration Act 2008 is amended as follows.

section 77 (power to alter penalty for unlawfully obtaining etc personal data), and
b
section 78 (new defence for obtaining etc for journalism and other special purposes).

Section 114 (supply of information to Secretary of State etc) is amended as follows.

In subsection (5), for “the Data Protection Act 1998 (c. 29)” substitute “
the data protection legislation

After subsection (6) insert—

In this section, “the data protection legislation” has the same meaning as in the Data Protection Act 2018 (see section 3 of that Act).
