General limits on powers to impose custodial sentences

1Sentence of imprisonment

No court may pass a sentence of imprisonment on an offender for an offence if the offender is aged under 21 when convicted of the offence.

Committal to prison

No court may commit a person who is aged under 21 to prison for any reason, except as provided by subsection (3).

Subsection (2) does not prevent the committal to prison of a person aged under 21 who is—

a

remanded in custody,

b

committed in custody for sentence, or

c

sent in custody for trial under section 51 or 51A of the Crime and Disorder Act 1998.
