Publication, duration and review of directions

Subject to sub-paragraph (2), the Scottish Ministers must publish a direction under paragraph 11.

Where a direction relates to a person specified by name—

a

the Scottish Ministers must give a copy of the direction to that person, and

b

the published version of the direction must not identify any individual without their consent.

A direction under paragraph 11 has effect until the earlier of—

a

the end of the period specified in the direction, or

b

the revocation of the direction by a further direction given by the Scottish Ministers.

Where a direction under paragraph 11 makes provision mentioned in paragraph 11(3), the Scottish Ministers must, so long as it remains in effect, review the direction—

a

before the end of the period of 21 days beginning with the date on which the direction was given; and

b

before the end of each subsequent period of 21 days.
