I1I232Judicial agreement to certain regulations

Where regulations under this Chapter are subject to the “concurrence requirement”, the Lord Chancellor—

a

must obtain the concurrence of the Lord Chief Justice before making the regulations if, or to the extent that, the regulations relate to—

i

civil proceedings in England and Wales, or

ii

family proceedings in England and Wales;

b

must obtain the concurrence of the Senior President of Tribunals before making the regulations if, or to the extent that, the regulations relate to proceedings in—

i

the First-tier Tribunal,

ii

the Upper Tribunal,

iii

employment tribunals, or

iv

the Employment Appeal Tribunal.

The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise the function of the Lord Chief Justice under subsection (1)(a).
