45Power to inform public about compliance failures

This section applies where the Secretary of State has reasonable grounds to believe that there is a compliance failure in relation to a relevant connectable product.

The Secretary of State may publish whatever information the Secretary of State considers appropriate for the purpose of informing members of the public about the following matters—

a

the nature of the compliance failure;

b

any risks posed by using the product;

c

any steps that may be taken to mitigate the effect of any such risks.

Information may be published under subsection (2) in whatever way the Secretary of State considers appropriate.

In this section “compliance failure”, in relation to a product, means a failure by a relevant person to comply with a relevant security requirement in relation to the product.
