Imposition of monetary penalties

(1)

Where an enforcement authority is satisfied beyond reasonable doubt that a person has committed an offence under section 1 or 2 in the authority’s area, the authority may impose a monetary penalty on the person.

(2)

In this Schedule “monetary penalty” means a requirement to pay the enforcement authority a penalty of an amount determined by the authority.

(3)

In Northern Ireland, the amount of the penalty may not exceed an amount equivalent to level 5 on the standard scale.
