46 Interpretation of Part II.E+W

[F1(1)In this Part of this Act:—

  • business ” has the meaning assigned to it by subsection (2) of section twenty-three of this Act;

  • [F2“current tenancy” means the tenancy under which the tenant holds for the time being;]

  • date of termination ” has the meaning assigned to it by subsection (1) of section twenty-five of this Act;

  • subject to the provisions of section thirty-two of this Act, “ the holding ” has the meaning assigned to it by subsection (3) of section twenty-three of this Act;

  • [F3“interim rent” has the meaning given by section 24A(1) of this Act;]

  • mining lease ” has the same meaning as in the M1 Landlord and Tenant Act 1927. ]

[F4(2)For the purposes of this Part of this Act, a person has a controlling interest in a company, if, had he been a company, the other company would have been its subsidiary; and in this Part—

  • “company” has the meaning given by [F5section 1(1) of the Companies Act 2006]; and

  • “subsidiary” has the meaning given by [F6section 1159 of that Act].]
