60Offences by corporations

Where any offence under Part I or Part V of this Act committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other officer of the body corporate, he, as well as the body corporate, shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.

61Application to Scotland

(1)Section three of the [24 & 25 Geo. 5. c. 18.] Illegal Trawling (Scotland) Act, 1934, shall have effect as if the reference in that section to section five of that Act included a reference to the Sea-Fishing Industry Act, 1933, as amended by Part II of this Act.

(2)Section fifty-eight of this Act and section thirty-seven of the Sea Fisheries Act, 1868, as amended by the said section fifty-eight, shall, in their application to Scotland, have effect as if for any reference in those sections to the Minister of Agriculture and Fisheries there were substituted a reference to the Secretary of State.

(3)Subsection (3) of section twenty-two of this Act shall, in its application to Scotland, have effect as if the word " summarily " were omitted.

62Interpretation

(1)In this Act the following expressions have the meanings hereby respectively assigned to them, that is to say :—

(2)Any reference in an Act passed before this Act to an enactment which is amended by this Act shall, unless the contrary intention appears, be construed as including a reference to that enactment as so amended.

63Short title and extent

(1)This Act may be cited as the Sea Fish Industry Act, 1938.

(2)Subject to any special provisions contained in this Act, this Act extends to the whole of the United Kingdom.
