British Settlements Act 1945

1945 CHAPTER 7

An Act to enable the powers conferred by the British Settlements Act, 1887, on His Majesty in Council to be delegated as well by Order of His Majesty in Council as by an instrument passed under the Great Seal of the United Kingdom, and to amend the provisions of that Act with respect to the persons to whom those powers may be delegated.

Be it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by .the authority of the same, as follows :—

1Amendment of s.3 of 50 & 51 Vict. c. 54.

Section three of the British Settlements Act, 1887 (which empowers His Majesty, by any instrument passed under the Great Seal of the United Kingdom or by any instructions under His Majesty's Royal Sign Manual referred to in any such instrument as made or to be made as respects any British settlement, to delegate to any three or more persons within the settlement all or any of the powers conferred by that Act on His Majesty in Council), shall have effect as if—

(a)any reference therein to an instrument passed as aforesaid included a reference to an Order of His Majesty in Council ; and

(b)for the reference therein to any three or more persons within the settlement there were substituted a reference to any specified person or persons or authority.

2Short title and citation.

This Act may be cited as the British Settlements Act, 1945, and the British Settlements Act, 1887, and this Act may be cited together as the British Settlements Acts, 1887 and 1945.
