Such money may be so applied as aforesaid upon an order of the Court of Chancery . . . F1 made on the petition of the party who would have been entitled to the rents and profits of the lands in respect of which such money shall have been deposited, [F2and if, before it is so applied, it is [F3invested under section 38 of the Administration of Justice Act 1982] the annual proceeds thereof shall be paid] to the party who would for the time being have been entitled to the rents and profits of the lands.
