Enemy Territory Cessation (France)

The Trading With the Enemy (Enemy Territory Cessation) (France) Order, 1953

6th May 1953

1.  The French territories hereinafter specified shall for the purpose of Section 3A, 4, 5 and 7 of the Trading with the Enemy Act, 1939, and for the purposes of any Order made under the said Section 7 cease to be treated as if they were enemy territory as from the date of this Order.

2.  The specified French territories are:—

being the territories of the French Franc Area (as defined in Article 1 of the Exchange Control (Payments) (French Franc Area) (No. 2) Order, 1951)(2), which have been enemy territory as defined in the Trading with the Enemy Act 1939 and in respect of which no Order under the said Regulation 6 has yet been made by the Board of Trade.

3.  This Order may be cited as the Trading with the Enemy (Enemy Territory Cessation) (France) Order, 1953.

EXPLANATORY NOTE

Regulation 6 of the Defence (Trading with the Enemy) Regulations, 1940, continued the Custodian of Enemy Property and Board of Trade control over the property in the United Kingdom of persons resident in a territory which had ceased to be in the occupation of the enemy.

The effect of the present Order is to complete the removal of this particular control from the money and property of persons resident in or carrying on business in territories of the French Franc Area which were occupied by the enemy.

Such control was by an Order dated 9th December, 1943, (S.R. & O. 1943, No. 1684), removed from Corsica, Syria and the Lebanon, French Somaliland, Algeria, The French Zone of Morocco, and Tunisia; and from the Saar Territory by an Order dated the 29th September, 1952 (1952 No. 1760).
