The Children and Young Persons Act 1969 (Commencement No. 3) (Amendment) Order 1970

In exercise of the powers conferred on me by sections 69(3) and 73(3) of the Children and Young Persons Act 1969, I hereby make the following Order:—

This Order may be cited as the Children and Young Persons Act 1969 (Commencement No. 3) (Amendment) Order 1970.

In Schedule 3 to the Children and Young Persons Act 1969 (Commencement No. 3) Order 19701 (transitional provisions) there shall be inserted after paragraph 2 the following paragraph:—

2A.

Without prejudice to the operation of sub-paragraph (1) of paragraph 12 of Schedule 4 to the Act, nothing in any provision of the Act brought into force by this Order shall affect the operation of section 102(1)(a) of the Act of 1933 in relation to such proceedings as are mentioned in sub-paragraph (2) of the said paragraph 12; but the said section 102(1)(a) shall have effect in relation to such proceedings as if a care order were among the orders mentioned therein.

EXPLANATORY NOTE

The Children and Young Persons Act 1969 (Commencement No. 3) Order 1970 brings certain provisions of the Children and Young Persons Act 1969 into force on 1st January 1971 and others on 1st April 1971. Schedule 3 to that Order contains transitional provisions having effect in connection with the provisions of the Act brought into force by the Order.

Among the provisions so brought into force on 1st January 1971 is paragraph 12 of Schedule 4 to the Act of 1969, which relates to supervision orders made before that date. The present Order adds to Schedule 3 a further transitional provision relating to appeals to quarter sessions where, by virtue of paragraph 12, proceedings in respect of such a supervision order are brought under section 66(1) of the Children and Young Persons Act 1933 (c. 12).
