The Pensions (Polish Forces) Scheme (Amendment) Order 1972

Coming into Operation

The Secretary of State for Social Services, with the consent of the Treasury, in exercise of the powers conferred upon him by section 1 of the Polish Resettlement Act 1947, and of all other powers enabling him in that behalf, hereby makes the following order:—

Citation, interpretation and commencement1

This order, which may be cited as the Pensions (Polish Forces) Scheme (Amendment) Order 1972, amends the Pensions (Polish Forces) Scheme 19641, as extended2, (hereinafter referred to as “the Scheme”), and shall come into operation on 2nd October 1972.

Amendment of Article 5 of the Scheme2

In Article 5 of the Scheme (entitlement) there shall be made the amendments set out in the Schedule hereto.

SCHEDULEAmendment of Article 5 of the Scheme

In Article 5 (entitlement) in paragraph (1) the words from “and provided further that” to the end of the paragraph shall be omitted, and paragraph (4) is hereby revoked.

EXPLANATORY NOTE

This order amends the Pensions (Polish Forces) Scheme 1964 so as to remove a restriction under which no award could be made in respect of the death of a member of the Polish forces, occurring more than 7 years after the termination of his service, unless he had been in receipt of a pension in respect of disablement.
