The Pensions Increase (Compensation To Court Officers) Regulations 1973

Coming into Operation

The Minister for the Civil Service, in exercise of the powers conferred on him by section 5(2) and (4) of the Pensions (Increase) Act 1971 and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

These Regulations may be cited as the Pensions Increase (Compensation to Court Officers) Regulations 1973, and shall come into operation on 4th April 1973.

The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.

The Pensions (Increase) Act 1971 shall have effect in relation to a pension payable under Part IV or Part V of the Courts (Compensation to Officers) Regulations 19711 as if it were specified in Part I of Schedule 2 to that Act.

Any increase of pension payable by virtue of these Regulations shall take effect from 1st December 1972.

EXPLANATORY NOTE

These Regulations provide for the payment of increases under the Pensions (Increase) Act 1971 on the following kinds of compensations payable under the Courts (Compensation to Officers) Regulations 1971:—

(a) long-term compensation for loss of employment or loss or diminution of emoluments;

(b) retirement compensation for loss of employment or loss or diminution of emoluments;

(c) compensation to the widow, child or other dependant or to the personal representatives of a claimant who was a pensionable officer.

The Regulations have retrospective effect from 1st December 1972 by virtue of section 5(4) of the Act.
