ROAD TRAFFIC

The Road Traffic Act 1974 (Commencement No. 5) Order 1975

The Secretary of State for the Home Department and the Secretary of State for Scotland, in exercise of the powers conferred by section 24(4) of the Road Traffic Act 1974 and according to their respective functions in relation to the provisions of that Act specified in this Order, hereby make the following Order:—

1.  This Order may be cited as the Road Traffic Act 1974 (Commencement No. 5) Order 1975.

2.  Sections 1 to 5 of and Schedule 1 to the Road Traffic Act 1974 (hereinafter referred to as “the Act”) shall come into operation on 1st September 1975 together with the provision in Schedule 7 which relates to section 80(10) of the Road Traffic Regulation Act 1967 and section 24(3) of the Act so far as it relates to that entry.

3.—(1) Nothing in this Order shall be construed as bringing any provision of the Act into operation as respects any offence referred to in paragraph (b) of section 1(1) of the Act alleged to have been committed before 1st September 1975 or as respects an excess charge alleged to have been incurred before that date.

(2) Section 4(5) of the Act shall not have effect in respect of offences alleged to have been committed before 1st September 1975.

EXPLANATORY NOTE

This Order brings into operation on 1st September 1975 sections 1 to 5 of and Schedule 1 to the Road Traffic Act 1974 (owner liability).
