The Secretary of State in exercise of powers conferred by sections 94 and 99 of the Patents Act 1949, as amended by the Patents Act 1957, the Patents and Designs (Renewals, Extensions and Fees) Act 1961 and the Patents (Fees Amendment) Order 1974(1), and now vested in him(2), and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Rules:—
1. These Rules may be cited as the Patents (Amendment No. 2) Rules 1975 and shall come into operation on 20th June 1975.
2. The Interpretation Act 1889 shall apply to the interpretation of these Rules as it applies to the interpretation of an Act of Parliament.
3. The Patents Rules 1968(3), as amended(4), shall have effect subject to the following further amendments:—
(a)to Rule 58 there shall be added the words “after the acceptance of a complete specification”;
(b)in Rule 64,
(i)before the words “before the expiration of that year” there shall be inserted the words “in the three months”; and
(ii)for the words “at any time before the expiration of three months from the date of sealing the patent” there shall be substituted the words “not more than three months before the expiration of the fourth or relevant succeeding year but before the expiration of three months from the date of sealing the patent”; and
(c)Rule 65 shall be deleted.

These Rules further amend the Patents Rules 1968 with effect from 20th June 1975 by limiting the periods within which annual renewal fees and sealing fees are payable in advance.
