TERMS AND CONDITIONS OF EMPLOYMENT

The Employment Protection Act 1975 (Commencement No. 9) Order 1977

The Secretary of State, in exercise of the powers conferred on him by section 129 of the Employment Protection Act 1975 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation

1.  This Order may be cited as the Employment Protection Act 1975 (Commencement No. 9) Order 1977.

Commencement

2.  The following provisions of the Employment Protection Act 1975 shall come into operation on 1st April 1978:—

(a)sections 57 (time off for carrying out trade union duties) and 58 (time off for trade union activities);

(b)section 59(4)(b) (regard to be had to time off under other sections for the purpose of determining time to be allowed off for public duties) as far as it is not already in operation, that is in relation to time off under sections 57 and 58;

(c)sections 60 (provisions as to industrial tribunals) and 62 (supplementary provisions) as far as they are not already in operation, that is in relation to sections 57 and 58; and

(d)section 63(2)(c) (priority of certain debts on insolvency) as far as it is not already in operation, that is in relation to any payment for time off under section 57(4).

EXPLANATORY NOTE

This Order brings into operation on 1st April 1978 the provisions of the Employment Protection Act 1975 which relate to time off for carrying out trade union duties and for trade union activities and to complaints to industrial tribunals under sections 57 and 58.
