The Medicines (Intra-Uterine Contraceptive Devices) (Appointed Day) Order 1978

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Scotland and in Wales, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of powers conferred by section 16(1) of the Medicines Act 1968(1), and now vested in them(2), and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by this order, hereby make the following order:—

1.  The day appointed for the purposes of section 16(1) of the Medicines Act 1968 as those provisions have effect in relation to intra-uterine contraceptive devices by virtue of Article 2 of the Medicines (Specified Articles and Substances) Order 1976 shall be 1st October 1978 for intra-uterine contraceptive devices.

2.  In this order “intra-uterine contraceptive device” means any instrument, apparatus or appliance for use by being inserted in the uterus of a human being for the purpose of contraception.

3.  This order may be cited as the Medicines (Intra-Uterine Contraceptive Devices) (Appointed Day) Order 1978.

EXPLANATORY NOTE

This Order appoints 1st October 1978 as the day from which the licensing restrictions on marketing, manufacture and wholesale dealing imposed by sections 7 and 8 of the Medicines Act 1968 and the restrictions on clinical trials imposed by section 31 of the Act shall, subject to certain transitional exemptions contained in sections 16 and 37 of the Act respectively, apply to intrauterine contraceptive devices. These and other specified provisions of the Act were applied to these devices by the Medicines (Specified Articles and Substances) Order 1976.

as applied to, and modified for the purposes of, intra-uterine contraceptive devices by the Medicines (Specified Articles and Substances) Order 1976 (S.I. 1976/968).

In the case of the Secretaries of State concerned with health in England and Wales by virtue of Article 2(2) of, and Schedule 1 to, the Transfer of Functions (Wales) Order 1969 (S.I. 1969/388), in the case of the Secretary of State concerned with agriculture in Wales by virtue of Article 2(3) of, and Schedule 1 to, the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272) and in the case of the Northern Ireland Departments by virtue of section 40 of, and Schedule 5 to, the Northern Ireland Constitution Act 1973 (c. 36), and section 1(3) of, and paragraph 2(1)(b) of Schedule 1 to, the Northern Ireland Act 1974 (c. 28).
