Exemption

2.—(1) The Employment Agencies Act 1973 shall not apply—

(a) to any services provided for its members by an organisation, or by a company established by any such organisation, being an organisation or company listed in Part I of the Schedule to these Regulations;

(b) to any services provided for its members by the organisation listed in Part II of the said Schedule;

(c) to any business carried on, or any services provided by, the Crown Agents for Oversea Governments and Administrations or by any of its wholly owned subsidiaries.

(2) (a) For the purposes of paragraph (1)(a) and (b) above—

“members” includes persons registered with the organisation as trainees or students,

and

(b) for the purpose of paragraph (1)(c) above—

“wholly owned subsidiary” shall be construed in accordance with section 150(4) of the Companies Act 1948.
