The European Communities (Definition of Treaties) (International Railway Tariffs Agreements) Order 1980

Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972 and has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the European Communities (Definition of Treaties) (International Railway Tariffs Agreements) Order 1980. It shall come into operation in respect of each treaty specified in the Schedule to this Order on the tenth day after the day on which it is made.

2.  The treaties specified in the Schedule to this Order are to be regarded as Community Treaties as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE

1.  Agreement between the Federal Council of the Swiss Confederation, the Governments of the Member States of the European Coal and Steel Community and the High Authority of the European Coal and Steel Community on the introduction of through international railway tariffs for the carriage of coal and steel through Swiss territory, signed at Luxembourg on 28th July 1956 and which entered into force on 1st June 1957 (Cmnd. 5892).

2.  Agreement between the Austrian Federal Government, the Governments of the Member States of the European Coal and Steel Community and the High Authority of the European Coal and Steel Community on the introduction of through international railway tariffs for the carriage of coal and steel through the territory of the Republic of Austria, signed at Luxembourg on 26th July 1957 and which entered into force on 1st March 1958 (Cmnd. 5891).

3.  Agreement concluded on 29th November 1960 between the Austrian Federal Government, the Governments of the Member States of the European Coal and Steel Community and the High Authority of the European Coal and Steel Community, supplementary to the aforesaid Agreement concluded at Luxembourg on 26th July 1957 between the same parties, and which entered into force on 6th November 1961 (Cmnd. 5891).

4.  Protocol between the Federal Council of the Swiss Confederation, the Governments of the Member States of the European Coal and Steel Community and the Commission of the European Communities supplementary to the Agreement of 28th July 1956 on the introduction of through international railway tariffs for the carriage of coal and steel through Swiss territory, signed at Brussels on 10th October 1974 and which entered into force on 17th September 1978 (Cmnd. 5892).

5.  Protocol between the Austrian Federal Government, the Governments of the Member States of the European Coal and Steel Community and the Commission of the European Communities supplementary to the Agreement of 26th July 1957 on the introduction of through international railway tariffs for the carriage of coal and steel through the territory of the Republic of Austria, signed at Brussels on 10th October 1974 and which entered into force on 6th November 1978 (Cmnd. 5891).

6.  Third Agreement concluded on 22nd November 1973, supplementary to the Agreement of 21st March 1955 on the establishment of through international railway tariffs (O.J. No. 9, 19.4.1955, p. 701), between the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting in Council and which entered into force on 1st March 1974 (Cmnd. 6258).

7.  Fourth Agreement concluded on 6th December 1979, supplementary to the Agreement of 21st March 1955 on the establishment of through international railway tariffs, between the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting in Council and which entered into force on 1st February 1980 (O.J. No. L315, 11.12.79, p.17).

EXPLANATORY NOTE

This Order declares the European Coal and Steel Community Agreements with Switzerland and Austria of 1956 and 1957 on the introduction of the through international railway tariffs for the carriage of coal and steel, the Agreement supplementary to the Agreement of 1957, and the 1974 Protocols thereto, whereby Denmark, Ireland and the United Kingdom became parties to those agreements, to be Community Treaties as defined in section 1(2) of the European Communities Act 1972. The 1956 and 1957 Agreements are pre-accession treaties within the meaning of the Act of 1972, but to which the United Kingdom accedes on terms settled after 22nd January 1972.

The Order also declares the Third and Fourth Supplementary Agreements to the Agreement of 21st March 1955 between the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting in Council, on the establishment of through international railway tariffs for the carriage of coal and steel to be Community Treaties as so defined, the 1955 Agreement being already a Community Treaty by virtue of the said section 1(2).
