In exercise of the powers conferred by paragraph 11 of Schedule 1 to the Local Government Act 1974, the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:—

1.  This Order may be cited as the Education Act 1944 (Termination of Grants) Order 1980 and, subject to its having been approved by resolution of each House of Parliament, shall come into operation on 14th July 1980.

2.  Subject to Regulation 3 below—

(a)with effect from 14th July 1980, no grant shall be paid to a local education authority in pursuance of section 100(1)(a)(iii) of the Education Act 1944(1) (grants in respect of expenditure in respect of removing defence works etc.);

(b)the said section 100(1)(a)(iii) is hereby repealed.

3.  Nothing in this Order shall affect the payment of grant in respect of expenditure incurred before 14th July 1980 and notified to the Secretary of State not later than 31st March 1981.

EXPLANATORY NOTE

This Order, which (subject to the approval of Parliament) comes into operation on 14th July 1980, terminates the payment of grants to local education authorities in respect of expenditure incurred in the removal of air-raid shelters and other defence works and repeals section 100(1)(a)(iii) of the Education Act 1944 (Article 2). There is a saving for the payment of grants in respect of expenditure incurred before that date which is notified to the Secretary of State not later than 31st March 1981 (Article 3); accordingly, the Removal of Defence Works Grant Regulations 1971 (S.I. 1971/534), made in pursuance of section 100(1)(a)(iii), will continue to have effect in relation to such expenditure.
