The Secretary of State for the Environment in exercise of the powers conferred by sections 1(5) and (6)(a) of the Local Authorities (Goods and Services) Act 1970 and now vested in him(1), and the Secretary of State for Wales in exercise of powers conferred by the said sections 1(5) and (6)(a), and of all other powers enabling them in that behalf, acting jointly hereby make the following order:—

Title and Commencement

1.  This order may be cited as the Local Authorities (Goods and Services) (Public Bodies) Order 1981 and shall come into operation on 24th August 1981.

Interpretation

2.  In this order:—

the 1970 Act” means the Local Authorities (Goods and Services) Act 1970, and

the Crown Agents” means the Crown Agents for Oversea Governments and Administrations.

Designation of Public Body

3.  The Crown Agents, being a person appearing to the Secretary of State for the Environment and the Secretary of State for Wales to be exercising functions of a public nature, shall be a public body for the purposes of the 1970 Act in its application to England and Wales.

Restriction of Agreements which may be entered into by the Crown Agents for the purposes of the 1970 Act

4.  Agreements which may be entered into by virtue of this order shall be for the purposes only of the provision by a local authority to the Crown Agents of administrative, professional or technical services.

EXPLANATORY NOTE

The Local Authorities (Goods and Services) Act 1970 enables local authorities to supply goods and services (subject to certain restrictions) to other local authorities and to public bodies. “Public body” means a person or description of persons appearing to the Secretary of State to be exercising functions of a public nature. This order, which extends to England and Wales, makes the Crown Agents for Oversea Governments and Administrations a public body for the purposes of the Act. The order restricts the agreements which the Crown Agents may enter into with a local authority for the purposes of the 1970 Act to agreements for the provision by the authority to the Agents of administrative, professional or technical services.
