Whereas the Secretary of State, in accordance with section 38(3)(a) of the Trade Descriptions Act 1968 has consulted with organisations appearing to him to be representative of interests substantially affected by this Order, and published on 3rd October 1980 notice of his intention to make the Order and of the place where copies of the proposed Order might be obtained:
And whereas by virtue of section 38(3)(b) of the said Act the Order is made with such modifications of the proposed Order as the Secretary of State thinks appropriate having regard to representations received by him:
Now, therefore, the Secretary of State, in exercise of the powers conferred by section 36(2)(a) of that Act and now vested in him(1), and of all other powers enabling him in that behalf, hereby makes the following Order:—
1. This Order may be cited as the Trade Descriptions (Country of Origin) (Cutlery) Order 1981 and shall come into operation on 1st January 1982.
2.—(1) This Order applies to any piece of cutlery of which the whole or any part is made of silver-plated stainless steel and which would have been suitable for supply by retail for domestic use without that piece or that part, as the case may be, having been silver-plated.
(2) In this Order, “cutlery” means
3. In relation to cutlery to which this Order applies, the process of silverplating or any process ancillary thereto shall be regarded for the purposes of section 36 of the Trade Descriptions Act 1968 as not resulting in a substantial change.
