The Secretary of State for the Environment, as respects England, the Secretary of State for Wales, as respects Wales, and the Secretary of State for Scotland, as respects Scotland, in exercise of the powers conferred on them by sections 71 and 104(1) of the Control of Pollution Act 1974, and of all other powers enabling them in that behalf, hereby make the following order:—
1. This order may be cited as the Control of Noise (Code of Practice on Noise from Audible Intruder Alarms) Order 1981 and shall come into operation on 1st February 1982.
2. Approval is hereby given to the code of practice prepared by the Secretary of State for the purpose of giving guidance on appropriate methods for minimising noise from audible intruder alarms, entitled “Code of Practice on Noise from Audible Intruder Alarms 1982”, and for the issue thereof on the date of coming into operation of this order.

Section 71 (codes of practice for minimising noise) of the Control of Pollution Act 1974 empowers the Secretary of State to prepare and approve and issue such codes of practice as in his opinion are suitable for the purpose of giving guidance on appropriate methods of minimising noise.
Section 72 (“best practicable means”) of the 1974 Act provides that references in the Act to “best practicable means” are to be construed in accordance with that section and, in particular, by having regard to any relevant provision of a code of practice approved under section 71.
This Order (which applies to England, Wales and Scotland) approves a code of practice which has been prepared by the Secretary of State for the Environment, the Secretary of State for Wales, and the Secretary of State for Scotland to give guidance on methods for minimising noise from audible intruder alarms (“burglar alarms”). The code of practice is entitled “Code of Practice on Noise from Audible Intruder Alarms 1982” and is obtainable from HM Stationery Office, 49 High Holborn, London WC1V 6HB, and from other Government Bookshops, and through booksellers.
