CONDITIONAL DISCHARGE AND PROBATION

Notification of discharge, etc., of probation order or order for conditional dischargeI128

Where a magistrates' court discharges a probation order or makes an order under section 11 of the Powers of Criminal Courts Act 1973 substituting an order for conditional discharge for a probation order and, in either case, the probation order was not made by that court, the clerk of the court shall—

a

if the probation order was made by another magistrates' court, notify the clerk of that court; or

b

if the probation order was made by the Crown Court, notify the appropriate officer of the Crown Court.

Where a magistrates' court deals with a person under section 6 or 8 of the said Act of 1973 in relation to a probation order or order for conditional discharge which was not made by that court the clerk of the court shall give notice of the result of the proceedings to the clerk of the court by which the order was made.

The clerk of a magistrates' court receiving a notice under this rule shall note the decision of the other court in the register against the entry in respect of the original order.
