Coming into Operation

In exercise of the powers conferred on me by sections 6 and 8 of the Metropolitan Public Carriage Act 1869, I hereby make the following Order:—

This Order may be cited as the London Cab Order 1982 and shall come into operation on 1st April 1982.

The London Cab Order 19341 shall be amended by omitting the following provisions:—

a

in paragraph 11 (fees for horse cab licences), sub-paragraph (1)(a) and, in sub-paragraph (2), the words “and the receipt for the payment of the fee as aforesaid”;

b

in paragraph 12(2) (certificate of Public Carriage Examiner), the words “and the receipt (if any) for the payment of the fee mentioned in paragraph 11”;

c

in paragraph 13 (refusal of certificate by Public Carriage Examiner) the words “and receipt (if any) for the payment of the fee mentioned in paragraph 11”;

d

in paragraph 26 (fees for cab drivers' licences), sub-paragraphs (1) and (2);

e

in Schedule C (form of cab licence), the words from “A receipt for the payment” to “produced to me”.

EXPLANATORY NOTE

This Order amends the London Cab Order 1934 to omit references to the fees payable for a cab licence and a cab driver's licence in the Metropolitan Police District and the City of London. In consequence of amendments made to the Metropolitan Public Carriage Act 1869 by section 35(1) and (2) of the Transport Act 1981 (c.56), which come into force on 1st April 1982 by virtue of the Transport Act 1981 (Commencement) (No. 4) Order 1982 (S.I. 1982/310), those fees cease to be prescribed by order and may be determined, with the approval of the Secretary of State, by the person granting the licence (an Assistant Commissioner of Police).
