The Social Security Benefit (Dependency) Amendment Regulations 1983

The Secretary of State for Social Services, in exercise of the powers conferred on him by sections 66(3) and 84(1) and (4) of the Social Security Act 1975, and of all other powers enabling him in that behalf, after reference to the Social Security Advisory Committee(1), hereby makes the following regulations:—

Citation and commencement

1.  These regulations may be cited as the Social Security Benefit (Dependency) Amendment Regulations 1983 and shall come into operation on 21st November 1983.

Amendment of the Social Security Benefit (Dependency) Regulations 1977

2.—(1) The Social Security Benefit (Dependency) Regulations 1977(2) (“the principal regulations”) shall be amended in accordance with the following provisions of this regulation.

(2) In the heading to regulation 3 of the principal regulations (allocation of contributions for wife or children) for the word “wife” there shall be substituted the word “spouse”.

(3) In regulation 3(1) of the principal regulations for the word “wife” in both places where it appears there shall be substituted the word “spouse”.

(4) In regulation 3(2) of the principal regulations for the word “wife” in each place where it appears there shall be substituted the word “spouse”.

(5) In the heading to regulation 8 of the principal regulations (increase of benefit in respect of wife and computation of earnings) for the word “wife” there shall be substituted the word “spouse”.

(6) In regulation 8(1) of the principal regulations for the word “wife” in each place where it appears there shall be substituted the word “spouse”, and for the word “her” there shall be substituted “that spouse's”.

(7) In regulation 8(3) of the principal regulations for the word “wife” there shall be substituted the word “spouse”.

(8) In regulation 11(1) of the principal regulations (contribution to maintenance of adult dependant) for the words “section 44(1), 45(2) or 66(1)(a)” there shall be substituted “section 44(1) and (3)(a), 45(2), 47(1)(a) or 66(1)(a)”; for the word “wife” in each place where it appears there shall be substituted the word “spouse”, and for the word “her” there shall be substituted “that spouse's or female person's”.

EXPLANATORY NOTE

These regulations amend the Social Security Benefit (Dependency) Regulations 1977.

They provide that, to secure equality of treatment between men and women, references to a wife in regulations 3(1) and (2) (which deal with allocations of contributions towards the maintenance of a wife or the cost of providing for children), 8(1) and (3) (which deals with increases of benefit in respect of a wife) and 11(1)(a) and (b) (which deals with contributions to the maintenance of an adult dependant), shall be replaced by references to a spouse.

The report of the Social Security Advisory Committee dated 23rd June 1983 on the draft of these regulations which had been referred to them, together with a statement showing that the Regulations give effect to the Committee's recommendations is contained in [Command Paper No. 8993] published by Her Majesty's Stationery Office.
