The Coast Protection (Variation of Excluded Waters) (River Wear) Regulations 1983

Coming into Operation

The Secretary of State for the Environment in exercise of the powers conferred by paragraph 113 of Schedule 4 to the Coast Protection Act 1949 and now vested in him1 and of all other powers enabling him in that behalf, hereby makes the following regulations:—

These regulations may be cited as the Coast Protection (Variation of Excluded Waters) (River Wear) Regulations 1983 and shall come into operation on 18th November 1983.

For paragraph 7 of Schedule 4 to the Coast Protection Act 1949 (which excludes part of the River Wear for the purposes of the definitions of “sea” and “seashore” in that Act) there shall be substituted the following paragraph, namely—

The River Wear, above a line drawn from the south-eastern corner of the pilot lookout station situated on the old North Pier to the north-western corner of the seaward face of the old South Pier.

EXPLANATORY NOTE

Schedule 4 to the Coast Protection Act 1949 excludes certain waters for the purposes of definitions of “sea” and “seashore” in the Act but provides that the Schedule may be varied by regulations.

Paragraph 7 of the Schedule excludes that part of the River Wear above a line drawn from the seaward end of the Roker Pier to the seaward end of the South West Breakwater Pier. These regulations vary the Schedule by substituting a new paragraph 7 which sets new boundaries reducing the part of the River Wear which is excluded.
