The Importation of Embryos, Ova and Semen (Amendment) Order 1984

Coming into Operation
The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1 and 10(1), (2) and (4) of the Animal Health Act 1981, and of all other powers enabling them in that behalf, hereby order as follows:—
Title and commencement1
This Order may be cited as the Importation of Embryos, Ova and Semen (Amendment) Order 1984 and shall come into operation on 13th September 1984.
Amendment of principal order2

The Importation of Embryos, Ova and Semen Order 1980 shall be amended in accordance with the following provisions of this article.

In article 4 (prohibition of landing of embryos, ova or semen), for paragraph (2) there shall be substituted the following paragraph—

After article 5 there shall be inserted the following article—
Action in case of disease5A

When a veterinary inspector suspects that any embryos, ova or semen—
a
which have been landed in Great Britain, or
b
which may have been in contact with embryos, ova or semen so landed, are or may be affected with disease, he may by notice in writing served on the owner or person in charge thereof require him, at the owner's expense and as the person on whom the notice is served may elect—
- a
to destroy such embryos, ova or semen in such manner and within such period as may be specified in the notice; or
- b
to export such embryos, ova or semen in such manner and within such period as may be specified in the notice.

Where the owner or person in charge of the embryos, ova or semen fails to comply with the requirements of a notice served under paragraph (1) above, a veterinary inspector may, without prejudice to any proceedings for an offence arising out of such failure, seize or cause to be seized the embryos, ova or semen to which the notice relates and carry out or cause to be carried out the requirements of the notice.

In this article the powers of a veterinary inspector in relation to any embryos, ova or semen extend to any container in which the embryos, ova or semen are carried.

In paragraphs (1), (3), (4) and (5) of article 6 (miscellaneous provisions) and in article 8 (summary offences) after the words “under article 5”
there shall be inserted “or 5A”
.
