The Secretary of State for Social Services, in exercise of the powers conferred upon him by section 32(2) of the Health and Social Services and Social Security Adjudications Act 1983, and of all other powers enabling him in that behalf, hereby makes the following order:—

Citation and interpretation

1.—(1) This order may be cited as the Health and Social Services and Social Security Adjudications Act 1983 (Commencement No. 5) Order 1984.

(2) In this order “the Act” means the Health and Social Services and Social Security Adjudications Act 1983.

Day specified for the coming into force of certain provisions of the Act

2.  The provisions of the Act specified in column 1 of the Schedule to this order (which relate to the matters specified in column 2 thereof) shall come into operation on 1st January 1985.

Article 2

SCHEDULEPROVISIONS OF THE ACT WHICH COME INTO FORCE ON 1ST JANUARY 1985

Provision of the ActSubject Matter
Section 11 except so far as it relates to paragraph 24 of Schedule 4.Registration of homes.
Section 29(1) so far as it relates to paragraphs 4, 6, 9, 11 to 14, 19, 26 and 27 of Part I of Schedule 9.Minor and consequential amendments.

Section 30(1) so far as it relates to the following entries in Part I of Schedule 10:—

(i) Local Government Act 1966;

(ii) Nursing Homes Act 1975;

(iii) section 58 of, and Schedule 3 to, the Child Care Act 1980;

(iv) theResidential Homes Act 1980 but not section 8 which was repealed on 1st January 1984:

(v) Children's Homes Act 1982.

Repeals.

EXPLANATORY NOTE

This order brings into force on 1st January 1985 section 11 of the Health and Social Services and Social Security Adjudications Act 1983 (registration of homes) except so far as it relates to paragraph 24 of Schedule 4 thereto which will be brought into force on 1st October 1984. The order also brings into force those consequential amendments and repeals, connected with section 11, in Schedules 9 and 10 to the Act; and one other outstanding minor amendment in paragraph 27 of Schedule 9.

Other Commencement Orders have been made under the Act (S.I. 1983/974, 1862, 1984/216 and 957) and a Note as to those orders listing the provisions brought into force by them can be obtained from Information Division, Department of Health and Social Security, Alexander Fleming House, London SE1 6BY.

The remaining provisions of the Act for which Commencement Orders have still to be made are as follows: section 2 (financing of community services in Scotland); sections 21 to 24 (recovery of charges for local authority accommodation); and section 30(1) and Part I of Schedule 10 (repeals) as regards repeals connected with those outstanding provisions.
