TELECOMMUNICATIONS

The Telecommunications Act 1984 (Appointed Day) (No.2) Order 1984

The Secretary of State, in exercise of the powers conferred upon him by sections 2, 60(1) and 110(2), (3) and (5) of the Telecommunications Act 1984, hereby makes the following Order:—

1.—(1) This Order may be cited as the Telecommunications Act 1984 (Appointed Day) (No. 2) Order 1984.

(2) In this Order, “the Act” means the Telecommunications Act 1984.

2.  The provisions of the Act specified in the first column of Schedule 1 to this Order (which relate to the matters specified in the second column of that Schedule) shall come into force on 16th July 1984.

3.  The day appointed for the purposes of Parts II to IV of the Act shall be 5th August 1984.

4.  The provisions of the Act specified in the first column of Schedule 2 to this Order (which relate to the matters specified in the second column of that Schedule) shall come into force on 5th August 1984.

5.  The day appointed for the purposes of Part V of the Act shall be 6th August 1984.

EXPLANATORY NOTE

By the Telecommunications Act 1984 (Appointed Day) (No. 1) Order 1984 (S.I. 1984/749)—

(i) section 1 of, and Schedule 1 to, the Telecommunications Act 1984 (“the Act”) (which relate to the Director General of Telecommunications);

(ii) section 108 of the Act (Extension to the Isle of Man and the Channel Islands); and

(iii) section 110 of the Act (short title, commencement and extent);

were brought into force on 18th June 1984.

This Order brings into force all the other provisions of the Act, other than section 96 and Part III of Schedule 7 and section 109(6) so far as relating to that Part, by—

(a) appointing 16th July 1984 as the day on which Part VI and section 109(6), so far as relating to Part IV of Schedule 7, of the Act, and Schedule 3 and Part IV of Schedule 7 to the Act (Provisions relating to Wireless Telegraphy) shall come into force (Article 2);

(b) appointing 5th August 1984 as the appointed day for the purposes of Part II (Provision of Telecommunication Services), Part III (Other Functions of Director) and Part IV (Provision of Cable Programme Services) of the Act (Article 3);

In accordance with the provision of section 110(2) of the Act, certain provisions which are ancillary to Parts II to IV, namely sections 2 to 4, 93 to 95, 97 to 99, 101 to 103, 106, 109(1) and Schedule 4, section 109(2), (3) and (7), Part I of Schedule 5 and section 109(4) so far as relating to that Part and Part I of Schedule 7 and section 109(6) so far as relating to that Part, will also come into force on 5th August 1984.

(c) appointing 5th August 1984 as the day on which certain miscellaneous and supplemental provisions, namely sections 100, 104, 105, 107 and 109(5) of the Act and Schedule 2 to the Act, shall come into force (Article 4); and

(d) appointing 6th August 1984 as the appointed day for the purposes of Part V of the Act (Transfer of Undertaking of British Telecommunications) (Article 5).

In accordance with the provisions of section 110(3) of the Act, certain provisions which are ancillary to Part V, namely Part II of Schedule 5 and Schedule 6 and section 109(4) so far as relating to that Part and that Schedule and Part II of Schedule 7 and section 109(6) so far as relating to that Part, will also come into force on 6th August 1984.

By virtue of section 110(4) of the Act, Part III of Schedule 7 and section 109(6) so far as relating to that Part will come into force on the dissolution of British Telecommunications.
