EDUCATION, ENGLAND AND WALES SEX DISCRIMINATION

The Further Education Act 1985 (Commencement) (No.1) Order 1985

In exercise of powers conferred on the Secretary of State by section 7(1) of the Further Education Act 1985, the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:—

This Order may be cited as the Further Education Act 1985 (Commencement) (No.1) Order 1985.

Section 4 of the Further Education Act 1985 shall come into force, as respects England and Wales, on 16th September 1985.

EXPLANATORY NOTE

This Order brings section 4 of the Further Education Act 1985 into force on 16th September 1985 so far as it relates to England and Wales.

Section 4 provides for the repeal of section 28(b) of the Sex Discrimination Act 1975 (c.65), which excepts physical training courses from the application of provisions of that Act making sex discrimination in education unlawful. The effect of the repeal is that these provisions will apply to any such course in England and Wales which begins in the 1985–86 academic year or later.

A separate Commencement Order will bring section 4 into force for Scotland. The remaining provisions of the Act come into force on the days specified in sections 7(2) and (3) of the Act: i.e. sections 5 to 8 on 16th July 1985 and sections 1 to 3 on 16th September 1985.
