The Airports Act 1986 (Commencement No. 2) Order 1986

The Secretary of State for Transport, in exercise of the powers conferred on him by section 85(5) and (6) of the Airports Act 1986, hereby makes the following Order:—

Citation and interpretation

1.  This Order may be cited as the Airports Act 1986 (Commencement No. 2) Order 1986.

2.  In this Order, “the Act” means the Airports Act 1986.

Commencement

3.  The date appointed for the coming into force of the entry relating to the Local Government, Planning and Land Act 1980in Part II of Schedule 6 to the Act and of section 83(5) of the Act so far as relating thereto is 8th September 1986.

4.  The date appointed for the coming into force of the provisions of the Act specified in the first column of Schedule 1 to this Order (which relate to the matters specified in the second column of that Schedule) shall, subject to the limitations (if any) specified in the third column of the Schedule, be 1st October 1986.

5.  The date appointed for the coming into force of the provisions of the Act which are not already in force by that date shall be 1st April 1987.

EXPLANATORY NOTE

This Order brings into force those provisions of the Airports Act 1986 (“the Act”) which are not already in force.

The Order brings into force on 8th September 1986 the repeal of section 72(4)(iii) of the Local Government, Planning and Land Act 1980 which is consequential upon the provisions of section 71 of the Act (capital controls in relation to certain local authority airport undertakings) which come into force on that day by virtue of section 83(4) of the Act (article 3).

The Order brings into force on 1st October 1986 Part IV including Schedule 1 and certain related provisions of the Act which make provision for the economic regulation of airports. The Order also brings into force on that day certain other provisions of the Act relating to the provision of special accommodation at airports (section 67), airport capacity (section 69) and the furnishing of information etc. to the CAA and restrictions on disclosure of information (sections 73 and 74) (article 4 and Schedule 1).

The Order appoints 1st April 1987 as the date for the coming into force of the remaining provisions of the Act. These all relate to the repeal of section 60(3)(o) of the Civil Aviation Act 1982 (c. 16) which empowers the Secretary of State to include in an Air Navigation Order provisions for regulating the charges that may be made for the use of, and for services provided at aerodromes licensed under the Order (article 5).
