Citation, commencement and interpretation

1.—(1) These regulations may be cited as the Companies (Forms) (Amendment) Regulations 1986 and shall come into force on 29th December 1986.

(2) In these regulations—

the Act” means the Companies Act 1985; and

the principal regulations” means the Companies (Forms) Regulations 1985.

Revocation and Savings

2.—(1) Subject to paragraph (2) below, the following provisions of the principal regulations are hereby revoked.

(a)Regulation 7(2);

(b)in Regulation 7(3), the words “or (2)”;

(c)in Schedule 3, Form Nos 469(Scot), 470(Scot), 478(Scot), 481(Scot), 482(Scot), 495(2)(a), 495(3)a, 495(3)b, and 497;

(d)in Part I of Schedule 4, the words “482”; and

(e)in Part II of Schedule 4, the words “495(3)a and 495(3)b”.

(2) Notwithstanding paragraph (1) above, the provisions of the principal regulations specified in that paragraph shall continue to apply in relation to any receiver appointed under section 467 of the Act before 29th December 1986 or to any receiver or manager appointed before that date to whom Part XIX of the Act applies.

EXPLANATORY NOTE

These regulations revoke certain provisions in the Companies (Forms) Regulations 1985 relating to receivers or to receivers and managers.

The revocations do not apply in relation to any receiver appointed under section 467 of the Companies Act 1985 (Receivers (Scotland) before 29th December 1986 or to any receiver or manager appointed before that date to whom Part XIX of that Act applies (Receivers and Managers (England and Wales)).

These Regulations are consequential upon the coming into force on 29th December 1986 of the Insolvency Act 1986 (c. 45) and the subordinate legislation made thereunder applying to receivers or to receivers and managers appointed on or after that date, namely the Insolvency Rules 1986 (S.I. 1986/1925), the Insolvency (Scotland) Rules 1986 (S.I. 1986/1915) and the Receivers (Scotland) Regulations 1986 (S.I. 1986/1917).
