Coming into force

The Secretary of State for Transport, in exercise of the powers conferred by section 50(1) of the Road Traffic Act 19721, now vested in him2, and of the powers conferred by section 56(1) and (2) of the Finance Act 19733 with the consent of the Treasury, and of all other enabling powers, and, in relation to the exercise of the powers conferred by section 50(1) of the Road Traffic Act 1972, after consultation with representative organisations in accordance with section 199(2) of that Act, hereby makes the following Regulations:

These Regulations may be cited as the Motor Vehicles (Type Approval and Approval Marks) (Fees) (Amendment) (No. 2) Regulations 1987 and shall come into force on 1st October 1987.

The Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 19844 are hereby further amended in accordance with the following provisions of these Regulations.

In Schedule 1–

a

in the Note at the head of the Schedule the following words shall be added after the word “Schedule” where it appears for the third time–

with the exception of Directive 80/780/EEC5, which appears opposite fee no 9100W, the particulars for which may be found in Schedule 4 to the Motor Vehicles (Designation of Approval Marks) Regulations 19796 as amended.

b

the fee numbers and the information shown against each fee number specified in the Schedule to these Regulations shall be inserted in the appropriate places according to numerical order;

c

in column 2(b) opposite fee number 0100G there shall be added after the words “Great Britain Regulations” the words “in so far as it relates to the entry immediately above this entry”.

d

in relation to those fee numbers which are listed in column 1 of the Table there shall be substituted for the existing fees listed in column 2 the new fees listed in column 3.

These Regulations further amend the Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1984 in the following ways–

a

Regulation 3(a) corrects an omission from the Note at the head of Schedule 1. The particulars of Directive 80/780/EEC are to be found in the Motor Vehicles (Designation of Approval Marks) Regulations 1979 as amended7.

b

Regulation 3(b) inserts new entries in Schedule 1 as a consequence of new or amended ECE Regulations: 1, 7, 8, 13, 20, 36 and 43.

c

One of the requirements for fee number 0100G, Item 6 to Schedule 1 to the Great Britain Regulations (the Motor Vehicles (Type Approval) (Great Britain) Regulations 19848) has been defined as relating to the requirement immediately preceding it in the Schedule, ECE Regulation 1 as revised and corrected up to 30th June 1985. This distinguishes fee number 0100G from fee number 0120H where item 6 to Schedule 1 to the Great Britain Regulations is defined as relating to ECE Regulation 1 as revised on 18th March 1986.

d

Regulation 3(d) substitutes new fees for certain fees listed in Schedule 1 following re-calculation of the number of man-hours required for the tests listed.
