[F125. A person—
(a)in respect of whom it has been determined for the purposes of section 171C of the Contributions and Benefits Act (the [F2personal capability assessment]) that he is not incapable of work; and
(b)who has made and is pursuing an appeal against the [F3decision which embodies a] determination that he is not so incapable,
but only for the period [F4beginning with the date on which that determination takes effect until] the determination of his appeal.]
