The Gaming Act (Variation of Monetary Limits) (Scotland) Order 1988

The Secretary of State, in exercise of the powers conferred on him by sections 21(8), 41(9) and 51(4) of the Gaming Act 1968(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1.—(1) This Order may be cited as the Gaming Act (Variation of Monetary Limits) (Scotland) Order 1988 and shall come into force on 18th July 1988.

(2) This Order extends to Scotland only.

2.  In section 21(2) of the Gaming Act 1968(2) (conditions on which gaming for prizes is permitted at licensed club premises) paragraphs (b) and (e) shall have effect as if, for the sum of £15 specified in each of those paragraphs, there were substituted the sum of £20.

3.—(1) The provisions of section 41 of the Gaming Act 1968 (gaming at entertainments not held for private gain) specified in column 1 of the Schedule to this Order (which relate to the maximum sums permitted in respect of the matters mentioned in column 2 of that Schedule) shall have effect as if, for the references in those provisions to the sums specified in column 3 of that Schedule(3), there were substituted references to the sums specified in column 4 of that Schedule.

(2) Paragraph (1) above shall have effect only in relation to entertainments held on or after the date on which this Order comes into force.

4.  In the Gaming Act (Variation of Monetary Limits) (Scotland) Order 1984(4)—

(a)in Schedule 1, the items relating to paragraphs (b) and (e) shall be omitted; and

(b)article 4 and Schedule 2 shall be omitted.
