The County Council of the Royal County of Berkshire A329(M) Relief Road Special Road Variation Scheme 1987 Confirmation Instrument 1988

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 16 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The County Council of the Royal County of Berkshire A329(M) Relief Road Special Road Variation Scheme 1987 is hereby confirmed with modification.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto. Copies of the Scheme with its accompanying plan are deposited at the Department of Transport and at the offices of the County Council of Berkshire at Shire Hall, Shinfield Park, Reading, Berkshire.

3.  The Scheme will come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the County Council of the Royal County of Berkshire A329(M) Relief Road Special Road Variation Scheme 1987 Confirmation Instrument 1988.

THE SCHEDULE TO THE INSTRUMENTTHE COUNTY COUNCIL OF THE ROYAL COUNTY OF BERKSHIRE THE A329(M) RELIEF ROAD SPECIAL ROAD VARIATION SCHEME 1987

The County Council of the Royal County of Berkshire makes this Scheme in exercise of its powers under Sections 16 and 326 of the Highways Act 1980 and of all other enabling powers:

1.  The Council are authorised to vary the Royal County of Berkshire A329 Relief Road Special Road Scheme 1969 No 1

(a)by deletion therefrom, that much of the special road as is described in the Schedule to this Scheme and shown on the deposited plan between the points given the reference letters “A” and “B”;

(b)by deletion therefrom, those connecting roads as are described in the Schedule to this Scheme and shown on the deposited plan between the points given the reference letters “D” to “C” and “K” to “L”.

2.  The centre line of the special road is indicated by a heavy black line on the deposited plan.

3.  All measurements of distance are measured along the route of the relevant highway.

4.  In this Scheme:

“the deposited plan” means the plan numbered 6989/19 marked “The County Council of the Royal County of Berkshire A329(M) Relief Road Special Road Variation Scheme 1987”, sealed with the Common Seal of the County Council and deposited at the offices of the Council at Shire Hall, Shinfield Park, Reading, Berkshire RG2 9XD. A certified copy is also deposited at the offices of the Secretary of State for Transport;

“the special road” means the special road which the County Council was authorised by the Royal County of Berkshire A329 Relief Road Special Scheme 1969 No 1 to construct;

“the motorway” has the same meaning as the special road; and

“the connecting roads” means the special roads mentioned in Article 1 of this Scheme and described in Part II of the Schedule to this Scheme.

5.  This Scheme may be cited as the County Council of the Royal County of Berkshire A329(M) Relief Road Special Road Variation Scheme 1987.

THE SCHEDULE TO THE SCHEME

PART IROUTE OF MOTORWAY TO BE DELETED

1.  That part of the motorway from its north western extremity, given the reference “A” on the deposited plan, eastwards then southeastwards for a distance of 750 metres to a point north of the A4 Trunk Road, given the reference letter “B” on the deposited plan.

PART IIROUTES OF CONNECTING ROADS TO BE DELETED

1.  The route starting at the north western boundary of the Sutton Seeds Roundabout (A4 Trunk Road) and ending at the northbound carriage of the main special road between the points given the reference letters “D” and “C” on the deposited plan.

2.  The route starting at the north eastern boundary of the Sutton Seeds Roundabout (A4 Trunk Road) and ending at the southbound carriageway of the main special road between the points given the reference letters “K” and “L” on the deposited plan.

Explanatory Note

Article 1 of the Scheme has been modified to make clear that the variations are to the Scheme of 1969 and not in relation to it.
