The Cheshire (District Boundaries) Order 1988

for the purposes referred to in article 1(2)
for all other purposes
The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 19721 and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect with modifications to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
Citation and commencement1

This Order may be cited as the Cheshire (District Boundaries) Order 1988.

This part shall come into force on 22nd February 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 19762.

For all other purposes this Order shall come into force on 1st April 1988.
Transfer from the district of Vale Royal to the City of Chester2
The part of the district of Vale Royal and parish of Delamere which is shown coloured yellow on the map prepared by the Department of the Environment, marked“Map of the Cheshire (District Boundaries) Order 1988” and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976 shall be transferred to:—
a
the City of Chester;
b
the Barrow ward of that City;
c
the parish of Kelsall;
d
the Gowy electoral division of the county of Cheshire;
e
the Chester petty sessional division.
Town and Country Planning3
Any provisions of a local plan adopted by the Vale Royal District Council which apply immediately before 1st April 1988 to the area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the Chester City Council.
