The Secretary of State for Social Services in exercise of powers conferred on him by section 15(1)(b) of the National Health Service Act 1977(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the National Health Service Functions (Directions to Authorities and Administration Arrangements) Amendment Regulations 1988 and shall come into force on 6th June 1988.

Amendment of Regulations

2.—(1) Regulation 10 of the National Health Service Functions (Directions to Authorities and Administration Arrangements) Regulations 1982(2) (arrangements by District Health Authorities for exercise of functions) shall be amended in accordance with the following provisions of this regulation.

(2) In paragraph (1) the words “the following paragraph of this regulation, to” shall be omitted.

(3) After paragraph (1) there shall be added the following paragraph–

(1A) Subject to any directions which may be given by the Secretary of State, functions of a District Authority exercisable by virtue of an order(3) under section 103(1) of the Act may by arrangement with that Authority be exercised on its behalf by a Family Practitioner Committee..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service Functions (Directions to Authorities and Administration Arrangements) Regulations 1982. Regulation 2 allows a Family Practitioner Committee to exercise any functions of a District Health Authority under section 103(1) of the National Health Service Act 1977 (which concerns special arrangements for remuneration).

1977 c. 49; see section 128(1) for the definition of “regulations”. Section 15(1) was amended firstly by Schedule 1, paragraph 90 to the Health Services Act 1980 (c. 53) and then by section 5(2) of the Health and Social Security Act 1984 (c. 48).

See S.I. 1988/865, which confers responsibility for remunerating those who provide pharmaceutical services on the orders of doctors employed by the Authority.
