Interpretation

5.—(1) In relation to the power of the Secretary of State to fix fees under sections 40 and 41 of the 1938 Act(1), the functions specified for the purposes of section 102(3) of the Act shall be those specified in Part II of Schedule 1 hereto.

(2) In relation to the power of the Secretary of State specified in paragraph (1) above, the matters specified for the purposes of section 102(4) of the Act shall be those specified in Part I and Part II of Schedule 2 hereto.

The 1938 Act was applied with modifications to service marks by the Trade Marks (Amendment) Act 1984 (c. 19), section 1 as amended by the Patents Designs and Marks Act 1986 (c. 39), section 2(1) and Schedule 3.
