SOCIAL SECURITY

The Social Security Act 1989 (Commencement No. 2) Order 1989

24th July 1989

The Secretary of State for Social Security, in exercise of powers conferred upon him by section 33(2) of the Social Security Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Social Security Act 1989 (CommencementNo. 2) Order 1989.

(2) In this Order unless the context otherwise requires, “the Act” means the Social Security Act 1989 and references to sections and Schedules are references to sections of and Schedules to that Act.

Appointed Day

2.—(1) The day appointed for the coming into force of the provisions of the Act specified in paragraph (2) below, insofar as they are not already in force, is 25th July 1989.

(2) The provisions of the Act mentioned in paragraph (1) above are—

(a)Schedule 8, paragraph 19 (joint citations) and section 31(1) (minor and consequential amendments) so far as it relates to it;

(b)sections 9 (extension to personal pensions of occupation pension provisions relating to the abatement of unemployment benefit and the meaning of “earnings”), 10 (unemployment benefit: requirement to seek employment actively), 11 (requalification for unemployment benefit), 12 (disqualification for unemployment benefit) and 13 (income support and unemployment), for the purpose only of authorising the making under the Social Security Act 1975(2), the Social Security (No. 2) Act 1980(3) or the Social Security Act 1986(4) as amended thereby of regulations which are expressed to come into force on or after9th October 1989.

Amendment of article 2(f) of the Commencement No. 1 Order

3.  In article 2(f) of the Social Security Act 1989 (Commencement No. 1) Order 1989(5) for the words “to the extent that they do not come into force on 21st July 1989, is9th October 1989”, there shall be substituted the words “is 9th October 1989 to the extent that they do not come into force before that date.”.

Explanatory Note

This Order provides for the coming into force on 25th July 1989, insofar as they are not already in force, of the following provisions of the Social Security Act 1989 (c. 24)

The Order also amends article 2(f) of the Social Security Act 1989 (CommencementNo. 1) Order 1989 (S.I. 1989/1238).
