The Secretary of State for Wales, in exercise of the powers conferred on him by sections 6(3) and (4) and 15(6) of the Local Government Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:–
1. These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (Wales) (Variation) Regulations 1989 and shall come into force on 3rd March 1989.
2. In paragraphs (3) and (4) of regulation 3 of the Local Government Act 1988 (Defined Activities) (Competition) (Wales) Regulations 1988(2) after the words “functional work” there shall be inserted the words “in Wales”.

Regulation 3(3) of the Local Government Act 1988 (Defined Activities) (Competition) (Wales) Regulations 1988 requires county councils who wish to carry out refuse collection work to compete for such work. Regulation 3(4) of the Regulations requires district councils who wish to carry out school and welfare catering work to compete for such work. It was intended that these provisions should apply only to work arising in Wales. These Variation Regulations vary the original Regulations so as to expressly provide for this.
